Respect for human rights is an essential characteristic of just societies. Since its recognition as a right through Magna Carta, human rights have found a cardinal place in societies, irrespective of the nature of society or the form of government. The pan human perspective of human rights helped all members of society-irrespective of their class, creed, community, gender, and nationality-to become bearers of the rights. With the evolution of society from medieval monarchies to more advanced forms of social governance in modernity, human rights became broader and inclusive. The human torture and sufferings during the War and inter-War periods prompted humanity to unite in the name of peace post War. This bonding was reinforced by individual and collective sense of human rights among the populace created by the Universal Declaration of Human Rights (UDHR). The UDHR thus became the symbol of the “enlightened conscience of mankind”. The UDHR and its subsequent adoption by international law produced a normativity to human rights which until then were deemed to be a natural right and a matter of social morality and good conscience. The second half of the 20 century thus witnessed the evolution of human rights as a positive law. This era also witnessed human rights becoming fundamental rights in constitutional democracies.
